Wimbo Community Guidelines

I. PREAMBLE AND PURPOSE
1.1 These Community Guidelines (“Guidelines”) are issued by Wimbo Au Pty Ltd, ACN 687 084 984, a company incorporated in Victoria, Australia and trading as “Wimbo” (hereinafter, “Wimbo”, “we”, “our”, or “the Company”), for the purpose of regulating user conduct, preserving community integrity, and ensuring compliance with applicable laws, ethical norms, and industry practices on the Wimbo mobile and web-based platform (the “Platform”).
1.2 These Guidelines are an integral component of the Wimbo Terms of Use and are legally enforceable under international e-commerce and digital services law. Violation of any provision herein may result in moderation action, account termination, or referral to civil or criminal authorities, as applicable.
II. LEGAL BASIS AND JURISDICTIONAL AUTHORITY
2.1 These Guidelines are underpinned by multiple domestic and international legal instruments, including but not limited to:
GDPR (EU Regulation 2016/679) – Arts. 5, 6, 21, and Recitals 38, 71 (profiling, lawful processing, platform duties);
California Consumer Privacy Act & Privacy Rights Act (CCPA/CPRA) – Cal. Civ. Code §§ 1798.100 et seq.;
UK Online Safety Act 2023;
Australian eSafety Act 2021, Online Safety (Basic Online Safety Expectations) Determination 2022;
Children’s Online Privacy Protection Act (COPPA) – 15 U.S.C. §§ 6501–6506;
Communications Decency Act, 47 U.S.C. § 230(c) (U.S. intermediary liability);
UNESCO Recommendation on the Ethics of Artificial Intelligence (2021).
III. CORE COMMUNITY STANDARDS
3.1 Prohibited Conduct
Wimbo maintains a zero-tolerance policy towards:
Hate speech, incitement to violence, or discrimination based on race, religion, sex, gender identity, sexual orientation, nationality, disability, or political affiliation;
Harassment, cyberstalking, defamation, or any targeted abuse of users or Wimbo staff;
Impersonation, identity misrepresentation, or deceptive profiles;
Unlawful promotion of drugs, weapons, trafficking, or fraudulent activity;
Graphic content, including sexual exploitation, nudity involving minors, or depictions of violence.
3.2 Platform Use Restrictions
Users are strictly prohibited from:
Circumventing moderation, safety features, or age filters;
Creating automated accounts or using bots to interact with the Platform;
Hosting events with the intent to cause harm, commit fraud, or deceive attendees;
Misusing Wimbot (AI assistant) for prohibited queries or misinformation.
IV. AGE-RESTRICTED ENGAGEMENT
4.1 Minimum Usage Age
Wimbo is a 16+ platform. By creating an account, Users affirm that they are at least sixteen (16) years of age. Users under the age of 18 may not attend “18+” designated events.
4.2 ID Verification at Events
Event Organizers are solely responsible for verifying attendee age at “18+” events. Wimbo disclaims liability for any failure to implement age verification and may suspend Organizers who neglect this duty of care.
V. KIDS EVENTS – SPECIAL CONDITIONS
5.1 Events labeled “Kids Events” must be:
Created and supervised by verified parents or legal guardians;
Designed for minors under parental control only;
Hosted in physical spaces where direct adult supervision is maintained throughout the duration.
5.2 No direct communication shall occur between unverified children on the Platform. All invitations and interactions must be parent-to-parent.
5.3 Violation of this clause may be reported to the eSafety Commissioner (AU), FTC (USA), or local child protection authorities, and may result in immediate account suspension or criminal referral.
VI. USER-GENERATED CONTENT (UGC)
6.1 All content submitted by Users (text, video, photos, event descriptions, audio, etc.) must:
Comply with intellectual property laws (e.g., 17 U.S.C. § 106, Copyright Act 1968 (Cth));
Not include copyrighted material without license (e.g., Spotify music, branded visuals);
Avoid defamatory or abusive content subject to removal under DMCA § 512(c)(3) and global takedown laws.
6.2 Users grant Wimbo a non-exclusive, royalty-free, worldwide license to use such content under the UGC & Licensing Policy. Misuse or infringement of third-party rights may result in takedown or legal action.
VII. SAFETY, REPORTING & ENFORCEMENT
7.1 Reporting Violations
Users may report other users, events, or content via the Platform’s “Report” function, or by emailing help@wimbo.au. Reports will be prioritized based on:
Threat to life or safety;
Abuse involving minors;
Community-wide disruption or coordinated harm.
7.2 Moderation Process
Wimbo may take moderation action as follows:

Law Enforcement Referral | Child exploitation, terror promotion, hate crimes |
Moderation includes AI-based filtering (GDPR Art. 22), but all final enforcement actions involve human administrative review.
VIII. ORGANIZER RULES AND RESPONSIBILITIES
8.1 Event Integrity Standards
Organizers must:
Provide accurate event details, including age category, cost, venue, and description;
Use Wimbo’s payment and escrow system for all paid events;
Not promote or host any event that violates laws in the host jurisdiction.
8.2 Refund Obligations
Refunds shall be processed according to the Refund & Escrow Policy. Organizers may not cancel events to avoid liability or to exploit users financially.
IX. VIOLATIONS AND LEGAL CONSEQUENCES
9.1 Legal Violations
Where a violation constitutes a breach of law, Wimbo reserves the right to:
Suspend or terminate accounts under emergency protection standards (UK Online Safety Act, CCPA § 1798.120);
Retain and disclose content to regulators or police upon valid request;
Seek damages for platform manipulation or reputational harm.
9.2 Arbitration and Dispute Resolution
All disputes arising under these Guidelines shall be subject to binding arbitration in accordance with the Rules of the American Arbitration Association (AAA), seated in New York, USA, unless prohibited by local consumer law.
