Wimbo Au Intellectual Property (IP) Notice

This Intellectual Property Notice (“Notice”) sets forth the ownership and permissible use of intellectual property (“IP”) associated with the Wimbo Au platform (“Platform”), operated by Wimbo Au Pty Ltd (“Wimbo Au,” “we,” “our,” or “us”). By accessing or using the Platform, you acknowledge and agree to the terms of this Notice, in addition to Wimbo Au’s Terms of Use, Privacy Policy, and Community Guidelines.

If you do not agree with this Notice, you must immediately cease all use of the Platform.

1. Ownership of Intellectual Property

1.1 Wimbo Au’s Intellectual Property

All content and materials available on the Platform (“Content”), including but not limited to text, images, design, graphics, software, video, sound, trademarks, service marks, and logos, are the exclusive property of Wimbo Au or its licensors. This includes, but is not limited to:

• Trademarks and Logos: The Wimbo Au name, logo, and any associated branding.

• Copyrighted Materials: Original works of authorship displayed on the Platform, such as designs, layouts, multimedia, and text.

• Software and Technology: The underlying code, algorithms, user interface, and any associated software or systems used to operate the Platform.

These materials are protected by copyright, trademark, patent, and other applicable intellectual property laws in Australia and internationally. Any unauthorized use, reproduction, or distribution of this Content is strictly prohibited and may result in legal action.

2. Limited License to Use

2.1 Permitted Uses

Wimbo Au grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform solely for personal, non-commercial purposes, in accordance with this Notice and the Terms of Use. Under this license, you may:

• Temporarily download or print Content for personal use.

• Share links to public Content on the Platform for personal or social purposes.

2.2 Prohibited Uses

The license granted does not permit you to:

• Modify, copy, reproduce, distribute, or create derivative works of the Content for commercial purposes.

• Use Wimbo Au’s trademarks, logos, or other branding for unauthorized purposes, including marketing, advertising, or product sales.

• Reverse engineer, decompile, or attempt to derive the source code or architecture of the Platform’s software or systems.

Unauthorized use of Wimbo Au’s intellectual property will result in the termination of your license and may lead to legal enforcement actions, including but not limited to claims for damages or injunctive relief.

3. User-Generated Content

3.1 Ownership of User Content

Users retain ownership of any content they upload, post, or otherwise contribute to the Platform (“User Content”).

3.2 License to Wimbo Au

By submitting User Content, you grant Wimbo Au a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, distribute, display, and modify such User Content as necessary for the operation, promotion, or improvement of the Platform.

3.3 User Responsibilities

You represent and warrant that your User Content does not infringe upon any third-party intellectual property rights. Wimbo Au reserves the right to remove or disable access to User Content that violates intellectual property laws or is otherwise inappropriate.

4. Copyright Infringement and DMCA Compliance

4.1 Reporting Copyright Infringement

If you believe that any Content on the Platform infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) or other applicable laws by providing the following information:

• Your physical or electronic signature.

• Identification of the copyrighted work(s) allegedly infringed.

• Identification of the infringing material, including its location on the Platform (e.g., URL or description).

• Your contact information, including address, telephone number, and email address.

• A statement that you have a good faith belief that the use of the material is unauthorized.

• A statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.

Upon receipt of a valid notice, Wimbo Au will take appropriate action, which may include removing or disabling access to the allegedly infringing Content.

4.2 Counter-Notification

If your Content is removed due to a copyright infringement notice and you believe this removal was in error, you may submit a counter-notification including:

• Your contact information (name, address, telephone number, and email).

• Identification of the removed Content and its location prior to removal.

• A statement, under penalty of perjury, that the removal was a result of mistake or misidentification.

• Your consent to the jurisdiction of a court of competent jurisdiction in your legal region.

• Your physical or electronic signature.

Wimbo Au will review your counter-notification and determine whether the Content should be restored.

5. Trademark Infringement

5.1 Reporting Trademark Infringement

If you believe your trademark rights have been violated, you may file a claim by providing the following:

• A description of the trademark and proof of ownership (e.g., registration certificate).

• Identification of the infringing material on the Platform.

• Your contact information (name, address, telephone number, and email).

• A statement of good faith belief that the use of the trademark is unauthorized.

• A statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the trademark owner.

6. Reporting Other IP Violations

If you believe another User has violated your intellectual property rights, please contact us at customersupport@wimbo.au with a detailed description of the alleged violation. Wimbo Au will investigate the matter and take appropriate action.

7. Changes to This Notice

Wimbo Au reserves the right to update or amend this Notice at any time to reflect changes in applicable laws, technologies, or Platform operations. Any significant changes will be communicated by updating the effective date at the top of this Notice. Continued use of the Platform after such changes constitutes acceptance of the revised terms.
