Wimbo Au Terms of Use

This Terms of Service agreement (“Agreement”) constitutes a legally binding contract between you (“User,” “you,” or “your”) and Wimbo Au Pty Ltd (“Wimbo Au,” “we,” “our,” or “us”), governing your access to and use of the Wimbo Au platform, including all related websites, mobile applications, and services (collectively referred to as the “Platform”).

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by this Agreement, our Privacy Policy, Content and Usage Guidelines, and any other policies referenced herein. If you do not agree to these terms, you must immediately discontinue your use of the Platform.

1. Acceptance of Terms

1.1 Binding Agreement

By using the Platform, you affirm that you have reviewed and accepted all terms outlined in this Agreement.

1.2 Modifications

Wimbo Au reserves the right to modify or amend this Agreement at its sole discretion. In the event of material changes, we will provide notice by updating the “Effective Date” and, where appropriate, through other communications. Continued use of the Platform after such modifications constitutes acceptance of the revised terms.

2. Eligibility

2.1 Age Restrictions

The Platform is intended exclusively for individuals who are at least 18 years of age. By creating an account or using the Platform, you represent and warrant that:

• You are at least 18 years old.

• The information you provide about your age and identity is accurate and truthful.

2.2 Compliance with Jurisdictional Laws

Users are responsible for complying with the age-related and other legal requirements of their respective jurisdictions.

2.3 Verification

Wimbo Au reserves the right to request proof of age or identity at any time. Accounts found to have been created with false or misleading information will be suspended or terminated without notice.

3. Use of the Platform

3.1 Purpose

The Platform is designed to facilitate social connections and enable Users to organize or participate in local events.

3.2 User Responsibilities

• Users must exercise reasonable judgment and caution in interactions and event participation.

• Wimbo Au does not guarantee the accuracy, reliability, or legitimacy of events, interactions, or content hosted on the Platform.

3.3 Disclaimer of Liability

Wimbo Au is not responsible for the actions, omissions, or behavior of any User, including event organizers or participants, nor for any disputes, damages, or losses arising from User interactions or event participation.

4. Account Creation and Security

4.1 Account Requirements

To access certain features of the Platform, you must create an account and provide accurate, complete, and up-to-date information.

4.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account. If you suspect unauthorized use, you must notify Wimbo Au immediately at customersupport@wimbo.au.

4.3 Account Termination

Wimbo Au reserves the right to suspend or terminate your account for any breach of this Agreement or other policies, or for any conduct detrimental to the Platform’s integrity.

5. User Content

5.1 License to Wimbo Au

By submitting or posting content on the Platform (“User Content”), you grant Wimbo Au a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and modify such content for the purposes of operating, promoting, and improving the Platform.

5.2 Prohibited Content

Users may not post or share content that:

• Violates applicable laws or regulations.

• Contains defamatory, obscene, abusive, or harmful material.

• Promotes illegal activities or encourages harm.

• Infringes upon intellectual property rights.

5.3 Content Removal

Wimbo Au reserves the right to remove any User Content that violates this Agreement or is otherwise deemed inappropriate at its sole discretion.

6. Event Participation

6.1 Event Types and Restrictions

• General Events: Open to Users aged 18 and older.

• Restricted Events: Events involving alcohol or other age-restricted activities are limited to Users aged 18 and older.

• Anonymous Events: Only Users aged 18 and older may host or participate in anonymous events.

6.2 Disclaimer

Wimbo Au provides the Platform as a facilitation tool and is not responsible for the organization, safety, or outcomes of any event. Users participate at their own risk and are solely responsible for their conduct and compliance with applicable laws.

7. Fees and Payments

7.1 Platform Fees

Certain features of the Platform may require payment of fees. By using these features, you agree to pay all applicable charges.

7.2 Non-Refundable Payments

All payments made through the Platform are non-refundable, except as required by law.

7.3 Event Fees

Event organizers may charge participation fees, and Wimbo Au is not liable for disputes between organizers and participants regarding such fees.

8. Prohibited Activities

Users are prohibited from engaging in any activity that:

• Violates any applicable laws or regulations.

• Promotes hate speech, harassment, or violence.

• Interferes with the Platform’s operation or the experience of other Users.

• Misuses the Platform for unauthorized commercial purposes.

Violation of this section may result in immediate account suspension or termination, in addition to any applicable legal consequences.

9. Intellectual Property

9.1 Ownership

All intellectual property associated with the Platform, including but not limited to trademarks, logos, software, design, and content, is the exclusive property of Wimbo Au.

9.2 Restrictions

You may not copy, modify, distribute, or reverse-engineer any aspect of the Platform without prior written consent from Wimbo Au.

10. Privacy

Your use of the Platform is subject to our Privacy Policy, which details how we collect, use, and safeguard your personal data. By using the Platform, you consent to the terms outlined in our Privacy Policy.

11. Limitation of Liability

To the fullest extent permitted by law, Wimbo Au shall not be liable for any direct, indirect, incidental, or consequential damages arising from:

• Your use of the Platform.

• Interactions or disputes between Users.

• Participation in events organized through the Platform.

The Platform is provided “as is,” without warranties of any kind.

12. Indemnification

You agree to indemnify and hold harmless Wimbo Au, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from:

• Your use of the Platform.

• Your breach of this Agreement.

• Your violation of any third-party rights.

13. Dispute Resolution

13.1 Informal Resolution

In the event of a dispute, Users agree to first attempt to resolve the matter through good-faith negotiations with Wimbo Au.

13.2 Arbitration

Unresolved disputes shall be submitted to binding arbitration in accordance with the laws of Victoria, Australia.

14. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Victoria, Australia. All disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts in Victoria, Australia.
